[1]               David Melding: Good afternoon. Welcome to this meeting of the Constitutional and Legislative Affairs Committee. I start with the usual housekeeping announcements. We do not expect a routine fire drill, so if we hear the alarm, please follow the instructions of the ushers, who will help us leave the building safely. Please switch all mobile devices to ‘silent’ mode or off. These proceedings will be conducted in Welsh and English. When Welsh is spoken, there is a translation on channel 1. [2]               David Melding: Item 2 is on instruments that raise no reporting issues. They are, however, listed there for us. Are Members content?

[3]               David Melding: Item 3 is on instruments that do raise reporting issues. They’re listed—just one regulation, and there’s an additional paper. It’s fairly routine, but are there any questions? We are content.

[4]               David Melding: There are a number of papers to note. There’s a copy of a letter from David Rees to Rosemary, regarding the supplementary legislative consent memorandum on the Small Business, Enterprise and Employment Bill. I think it’s just an exchange of correspondence, really, to complete that item. There’s a letter on behalf of the First Vice-President of the European Commission, in response to our correspondence on the democratic legitimacy of the EU and our role in the legislative process, and it obviously acknowledges the role of what they call ‘regional’ parliaments. It’s a polite exchange. Are we happy?

 

[5]               There’s a written statement, then, by Mark Drakeford about the Medical Innovation Bill and this Bill has now, in effect, fallen because of the dissolution of Parliament, but it obviously does raise an awkward issue, which at some point we may want to comment on, particularly that we don’t have a right to refer a matter to the Supreme Court that, you know, we feel needs to be contested or if the UK Government’s position should be challenged.

 

[6]               Then there’s a letter from Huw Vaughan Thomas, Auditor General for Wales, relating to our inquiry into making laws in the fourth Assembly. It’s very helpful and interesting and I know it’s out of time, in a way, but given that it’s such a relevant response, and given that we’ve got time, in terms of drafting our report, might we want to invite him in and discuss this matter with him?

 

[7]               Suzy Davies: I thought that was a very helpful paper.

 

[8]               David Melding: Yes. I think if we can manage it—. I’ll ask the secretariat, and if we can identify a convenient slot we’ll ask him in and have further oral evidence. If not, obviously, the written evidence via the letter stands, and is very helpful.
